FURTHER DEVELOPMENTS ON “C&AG AUDIT REPORT” ON DISCOMS, WHICH TURNED OUT TO BE ONLY A DRAFT REPORT
A few days back The Times of India carried a news item in which it was reported that the C&AG in their Audit Report on the private power distribution companies (DISCOMS) operating in Delhi had pointed out that these discoms had manipulated their records with a view to over-charge the consumers. The news report was analysed by us and a summary was published on this website.
2.It has now been reported that the Report containing these findings was a draft report only. According to the prescribed procedures, the Draft Report is in the first instance forwarded to the agency concerned for its comments and only when these are received and considered by the Audit, the Audit Report is finalized. In other words, it is possible that the final findings in the Audit Report may be different from the findings contained in the Draft Report.
3.The press reports now indicate that BSES Rajdhani Power Pvt. Ltd (BRPL) and BSES Yamuna Power Pvt. Ltd. (BYPL) filed a petition in the Delhi High Court seeking direction to furnish a copy of the Draft Report to them and restrain the Government of NCT of Delhi from taking any action on the basis of the Draft report, which plea is reported to have been accepted by the Hon’ble High court.
4.On behalf of C&AG, the Hon’ble Court was reported to have been informed that the report had been forwarded to the Govt. of NCT of Delhi for comments and it was for that Govt. to forward the relevant portions of the Report to the discoms concerned for obtaining their views. The Hon’ble Court was further informed on behalf of C&AG that while forwarding the draft report, the Government of NCT of Delhi was specifically requested to maintain its confidentiality as the issue of audit of discoms was sub-judice.
5.Meanwhile, the third discom, namely, Tata Power Delhi Distribution Ltd. (TPDDL) are reported to have confirmed that they have received a copy of the draft Report but were handicapped in taking further action in the matter as the document was marked “Secret and confidential” and they had also been instructed to not reveal any content thereof.
